Skilled workers, technicians and site supervisors in short supply in the construction industry; occupations in short supply in the transport industry; and 26 occupations covered by the Supplementary Labour Scheme (sales representatives, salespersons, cashiers, junior cooks, etc.).

Can employers recruit imported workers and handle the relevant procedures on their own in the Mainland?
If the workers to be imported are mainland residents, employers must recruit them through a labor service enterprise. A labor service enterprise is an enterprise that has been approved by the Ministry of Commerce of the People’s Republic of China and has obtained qualifications for labor cooperation operations in the Hong Kong Special Administrative Region (HKSAR). Employers applying to the Immigration Department for a visa/entry permit to import workers must submit the following documents:
i. An original copy of the “Declaration and Authorization Form” (ESLS-11) completed and signed by the individual worker to be imported, which must clearly indicate the name of the labor service company arranging their work in Hong Kong;
ii. And a copy of the “Joint Declaration on Labour Cooperation between the Mainland and the Hong Kong Special Administrative Region” (ESLS-12) (hereinafter referred to as the “Joint Declaration”) completed and signed by the employer and the authorized labor service company.
Please note that one of the conditions for the Government’s granting of in-principle approval to employers is that the employer must submit the above documents and meet the above recruitment requirements. If the employer fails to meet the above recruitment requirements and/or the information contained in the documents listed in (i) and (ii) above is incomplete or incorrect, the Immigration Department will not process the application for a visa/entry permit to import Mainland workers. At the same time, the employer must arrange for each approved application to be processed. The commissioned labour service company must complete a “Joint Declaration on Labour Service Cooperation between the Mainland and the Hong Kong Special Administrative Region” and have it signed and stamped by the employer and the person in charge or authorized representative of the labour service company. The above requirements also apply to the employer’s subsequent applications for replacement workers.

Not recommended. After entering Hong Kong, imported workers are required to work within the scope of duties and at the designated location specified in their employment contract. Applying for a change of work location involves complex procedures.

Imported workers’ wages must not be lower than the most recently compiled monthly median wage for their industry, as reported by the Census and Statistics Department. Imported workers enjoy benefits similar to those of local workers and are protected by Hong Kong labor laws, including paid leave, medical benefits, and no Mandatory Provident Fund contributions.

Payment can be made by bank transfer. If you do not have a bank account, you can temporarily pay by cash or check, and you must keep proper records.

Generally speaking, employers are required to provide imported workers with accommodation that meets the standards set out in the Schedule to the Standard Employment Contract and must maintain such standards at all times. If the imported workers are Mainland residents, employers may choose to provide accommodation for the imported workers in Hong Kong, in the Mainland, or at their own residence in the Mainland. The Mainland accommodation arranged by the employer must also meet the standards set out in the Schedule to the Standard Employment Contract.
Employers should prepare such accommodation before the imported workers arrive. During the imported workers’ stay, the Labour Department will require the employer to arrange for labor inspectors to inspect the imported workers’ residences in Hong Kong. The amount of accommodation fees that may be deducted from the wages payable to the imported workers for the period of occupation should be equal to the actual cost of accommodation during that period or 10% of the wages (excluding overtime pay) payable to the imported workers for the period calculated under the Standard Employment Contract, whichever is less.
